Compliance and Disclaimer
This page explains what MyPBM is, what it is not, and what you should keep in mind when using it. It applies to the MyPBM website and application (together, the “Platform”), operated by GLIA HONG KONG HOLDINGS CO., LIMITED. It forms part of our Terms of Use.
1. Intended purpose
MyPBM is a document management and emergency information tool. It enables you to create, store, maintain, and present your own advance directive, and to access a library of educational reference material drawn from identified clinical sources. It brings together in one place the legal document you have authored, the information you want to share with responders in a medical emergency, and the educational material you have chosen to carry.
MyPBM is not a medical device within the meaning of the UK Medical Devices Regulations 2002 (as amended), the EU Medical Devices Regulation 2017/745, the United States Federal Food, Drug, and Cosmetic Act, or equivalent regulations in other jurisdictions. It does not perform diagnosis, prevention, monitoring, or treatment of any disease or physiological condition. It does not interpret your inputs to produce clinical output, does not connect to medical hardware, and does not make any medical decision.
2. Clinical limitations
The information contained in the Platform, including the clinical reference library, is educational in nature. It is drawn from peer-reviewed sources and published clinical guidelines, and each entry is attributed to its original author.
The educational material is not personalised to your individual medical circumstances. It is not a substitute for clinical judgement. MyPBM does not diagnose, treat, cure, or prevent any medical condition. You should consult a qualified healthcare professional for medical advice, diagnosis, or treatment, and you should not delay seeking or disregard such advice on the basis of anything you read in the Platform.
The emergency display screen within the application presents the preferences you have declared for yourself. It is not a clinical recommendation to any attending medical professional. Decisions about your care remain the responsibility of the clinicians attending to you, informed by your declared preferences and the applicable law.
3. Legal nature of the documents you create
Advance directives and other legal documents you create using the Platform are your own declarations. Their legal validity depends on the requirements of the jurisdiction in which you rely on them, including formal requirements for witnessing, signing, dating, and the capacity of the person making the declaration.
MyPBM does not provide legal advice. The templates and prompts in the Platform are designed to help you express your preferences clearly, but they cannot account for every circumstance or every jurisdiction. You are responsible for ensuring that any document you create satisfies the legal requirements that apply to you. You are encouraged to seek independent legal review, particularly where your circumstances are complex, where the document will apply to life-sustaining treatment, or where you are likely to rely on it in more than one jurisdiction.
In England and Wales, the Mental Capacity Act 2005 governs the validity of advance decisions to refuse treatment. Comparable frameworks apply in other parts of the United Kingdom and in other jurisdictions. Courts have found that advance decisions may lose legal effect where the person making them has acted inconsistently with them over time, or where circumstances have changed materially since they were made. We recommend that you review and reaffirm your advance directive at least once every twelve months, and after any material change in your health, your family circumstances, or your legal jurisdiction.
4. The Platform is not a substitute for clinical or legal support
MyPBM complements, but does not replace, the professional support that is available to you. In particular:
- For medical advice, diagnosis, or treatment, consult a qualified healthcare professional.
- For legal advice on the validity of your advance directive, or on the choice of healthcare agent or other surrogate decision-maker, consult a qualified lawyer practising in the relevant jurisdiction.
- For spiritual and practical support in medical settings, where relevant, your local Hospital Liaison Committee or equivalent community resource can offer education, coordination, and advocacy.
5. Platform availability
We will use reasonable efforts to keep the Platform available, but we do not guarantee uninterrupted access. You should not rely on the Platform as your sole means of communicating your advance directive in an emergency. We recommend keeping a printed and properly witnessed copy of your advance directive accessible alongside any digital copy stored in the Platform, and ensuring that your healthcare agent and close family members know where to find it.
6. Changes to this disclaimer
We may update this disclaimer from time to time. Where a change is material, we will notify you in accordance with our Terms of Use. The current version number and effective date appear at the top of this page.
